Welcome to DigiSim.io! These Terms of Service ("Terms") govern your use of the DigiSim.io website, services, and applications (collectively, the "Service"), operated by DigiSim Technology Ltd ("we," "us," or "our").

Please read these Terms carefully before using our Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. License Overview (Quick Summary)

One-Time Payment: This Service operates on a one-time transactional basis. It is NOT an auto-renewing subscription.

12-Month Active Period: Purchase grants 365 days of full access to create and edit projects.

Perpetual Viewer Mode: After 365 days, your account transitions to "Viewer Mode." You retain the right to log in, view, simulate, and export all existing data forever at no additional cost.

Manual Renewal Only: We do not store payment credentials for automatic charges. Any extension of the Active Period must be initiated manually by the User.

2. Description of Service

DigiSim.io provides an interactive, web-based platform for learning, creating, and simulating digital logic circuits. The Service is designed for educational purposes to help students, hobbyists, and professionals understand the principles of digital electronics.

3. User Accounts

Account Creation: To access most features of the Service, including saving and managing circuits, you must register for an account. You agree to provide accurate, current, and complete information during the registration process.

Account Responsibility: You are responsible for safeguarding your account password and for any activities or actions under your account. You agree to notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Age Requirement: The Service is available to users of all ages. However, if you are under the age of 13, you must have the consent of a parent or legal guardian to use the Service.

Third-Party Authentication

Google Sign-In:

  • We offer Google Sign-In as a convenient authentication option
  • By using Google Sign-In, you agree to comply with Google's Terms of Service
  • We only request access to your basic Google profile information (email, name, profile picture)
  • You can manage or revoke DigiSim.io's access to your Google account at any time through your Google Account settings

Authentication Security:

  • We do not store your Google password or access your Google services beyond authentication
  • Your Google account credentials are managed entirely by Google's secure infrastructure
  • We use OAuth 2.0 industry-standard protocol for secure authentication

Account Linking:

  • If you create an account with Google Sign-In, your DigiSim.io account will be linked to your Google email address
  • You are responsible for maintaining the security of your Google account
  • If your Google account is compromised, please immediately change your Google password and contact us

4. DigiSim Pro Terms

Definition of License

The "DigiSim Pro" is a fixed-term commercial license with a perpetual fallback for data access. It is not a subscription. Upon purchase, the User is granted rights in two distinct phases:

Phase 1: The Active Period (Days 1–365)

The User is granted a non-exclusive, non-transferable right to access all premium features of the DigiSim.io platform. This includes creating new projects, saving modifications to existing projects, and utilizing advanced simulation components.

Phase 2: The Viewer Period (Day 366 onwards)

Upon expiration of the Active Period, the User's account automatically transitions to "Viewer Mode". In this mode, the User retains the right to log in, view, simulate, and export existing projects. The User acknowledges that saving changes or creating new projects is disabled in Viewer Mode unless a new license is purchased.

Non-Recurring Payment Policy

DigiSim.io does not store payment credentials for the purpose of automatic renewal. The fee is a one-time transactional payment. We will never automatically charge your account upon the expiration of the Active Period.

Service Continuity ("Lifetime" Definition)

References to "Lifetime" or "Perpetual" access refer to the Lifetime of the Service.

  • Best Effort: DigiSim commits to maintaining the "Viewer Mode" functionality for as long as the platform remains commercially or operationally viable.
  • Sunset Clause: In the event that DigiSim.io ceases operations, we guarantee a minimum notice period of 30 days. During this period, full data export tools will be provided to allow Users to download their proprietary data (JSON format).
  • Limitation: DigiSim is not liable for refunds if the Service is discontinued after the User's initial 12-month Active Period has been fulfilled.

Payment Processing

We use third-party payment processors (e.g., Stripe) to handle payments. We are not responsible for any errors by the payment processors.

Refund Policy

All purchases are final and non-refundable, except as required by law. We generally do not offer refunds once the purchase is completed and the account has been activated or accessed. For detailed information on exceptions and our full policy, please refer to our Refund Policy.

5. User-Generated Content

Your Content: You retain all ownership rights to the digital circuits, designs, and other content you create, upload, or save on the Service.

License to Us: By creating or uploading User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Service.

Responsibility: You are solely responsible for your User Content and represent that you have all necessary rights to grant us the license for your User Content.

6. Storage and Fair Use Policy

While DigiSim.io provides extensive cloud storage capable of holding thousands of circuit files, our service is governed by a Fair Use Policy to prevent abuse and ensure server stability for all users.

Generous Allowance

The storage provided is calculated to far exceed the requirements of typical academic coursework or professional prototyping (e.g., storage for 1,000+ distinct project files). For legitimate human users, this limit is virtually unreachable.

Prohibited Activities

You agree not to use the Service for:

  • Bulk/Automated Creation: Using scripts, bots, or automation tools to generate or upload massive quantities of files.
  • Non-Circuit Data: Attempting to store non-JSON data, binary files, or data totally unrelated to logic simulation (e.g., using project metadata fields as a file host).
  • Excessive Load: Creating an abnormal number of projects (e.g., hundreds per day) that exceeds the speed of human operation.

Enforcement

If we detect usage patterns consistent with bot activity or abuse that threatens system performance, DigiSim reserves the right to throttle API access, temporarily suspend write permissions, or, in extreme cases, terminate the account without refund.

7. Acceptable Use Policy

You agree not to misuse the Service or help anyone else to do so. You agree not to:

  • Probe, scan, or test the vulnerability of any system or network
  • Breach or otherwise circumvent any security or authentication measures
  • Access, tamper with, or use non-public areas of the Service
  • Interfere with or disrupt any user, host, or network
  • Use the Service for any illegal or unauthorized purpose
  • Reverse-engineer or decompile the Service

8. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of DigiSim Technology Ltd and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

9. Termination

By You: You may terminate your account at any time by using the account deletion feature or by contacting us.

By Us: We may suspend or terminate your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including if you breach the Terms.

Survival: All provisions of the Terms which by their nature should survive termination shall survive termination.

10. Disclaimer of Warranties & Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Your use of the Service is at your sole risk. The Service is provided without warranties of any kind, whether express or implied.

In no event shall DigiSim Technology Ltd, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

11. Governing Law and Dispute Resolution

Governing Law: These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Jurisdiction: Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Consumer Rights: Nothing in these Terms shall limit any consumer protection rights you may have under your local law.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
